1. About SnipCam

SnipCam is an application that automatically extracts a subject from a photo taken with a smartphone and provides background removal and other image-editing functions.

• Photo capture using the camera
• Automatic subject extraction and background removal
• Transparent backgrounds
• Background color replacement
• Outline effects
• Fisheye and other image effects
• Original and edited image preview
• PNG or JPEG export
• Saving to the device
• Sharing through Android sharing functionality

Image processing is performed on the user's device in principle.

2. Accounts

No SnipCam-specific account registration is required to use SnipCam. A Google Account or other requirements imposed by Google Play may be necessary to purchase SnipCam Pro.

3. Photos Used by Users

Users must use SnipCam only with photos they have taken themselves or otherwise have the right to use. Using SnipCam does not transfer copyright or other rights in a user's photos to us.

If an image includes another person or otherwise involves third-party rights, the user is responsible for obtaining any permission required for that use.

4. Automatic Image Processing

SnipCam uses automatic image analysis and machine-learning models for background removal and other processing. Accordingly, complete or perfectly accurate results are not guaranteed for every image.

• Hair or animal fur
• Whiskers
• Thin parts
• Transparent or semi-transparent objects
• Areas where the subject and background have similar colors
• Complex backgrounds
• Dark images or strong backlighting
• Extremely small subjects

Users should review the processed result before saving or sharing it.

5. Free Use

Free users may use the first three exports in SnipCam.

For these Terms, an "export" means an action that saves or shares a processed result outside the App. Each successfully completed Save or Share action consumes one free export. If the same processed result is saved or shared multiple times, each completed action is treated as a separate export.

The following actions alone do not consume a free export:

• Taking a photo
• Background removal
• Editing
• Previewing
• A Save or Share action that is not successfully completed
• An incomplete purchase process

After all three free exports have been used, capture, background removal, editing, and preview remain available unless we state otherwise. SnipCam Pro is required for any further Save or Share action.

6. SnipCam Pro

SnipCam Pro is a paid service that removes SnipCam's export limit. While a valid SnipCam Pro subscription is active, users may use SnipCam's supported PNG, JPEG, save, and share functions without an export-count limit.

SnipCam Pro is offered through Google Play as an annual subscription. The actual price and currency shown in the app and by Google Play at the time of purchase apply.

7. Automatic Renewal

SnipCam Pro is an automatically renewing subscription. Unless the user cancels the subscription through Google Play, it will automatically renew for the next subscription period after the current period ends.

The renewal charge is billed through the payment method registered with Google Play. Price changes are handled according to Google Play rules and applicable law.

8. Cancellation

SnipCam Pro subscriptions can be cancelled through the Google Play subscription-management screen.

Uninstalling SnipCam from the device does not automatically cancel the subscription.

Unless Google Play provides otherwise, SnipCam Pro generally remains available until the end of the already-paid subscription period after cancellation.

The timing and effect of cancellation are subject to Google Play's applicable terms.

9. Restore Purchase

If Google Play has a valid record of a SnipCam Pro purchase, the user may use the restore-purchase function in the app to recheck purchase status. Restoration may require use of the same Google Account used for the original purchase and may be subject to other Google Play requirements.

10. Payments and Refunds

SnipCam Pro payments are processed through Google Play. We do not directly obtain complete payment-card information from users.

Purchase cancellation, refunds, and other payment-related matters are governed by Google Play policies and applicable law.

11. Prohibited Uses

Users must not use SnipCam for any of the following:

• Conduct that violates applicable law
• Use in connection with criminal activity
• Infringement of another person's copyright or other intellectual-property rights
• Infringement of another person's portrait, publicity, or privacy rights
• Fraudulent use of images intended to deceive others
• Harassment, threats, defamation, or other infringement of another person's rights
• Improper circumvention of SnipCam export limits or purchase verification
• Modification of or interference with SnipCam or Google Play billing
• Interference with the normal operation of the app
• Other conduct that infringes the rights or legitimate interests of us or any third party

12. Storage and Backup

Users are responsible for saving and managing images created with SnipCam. Images or settings may be lost due to device failure, storage failure, app deletion, operating-system data deletion, or other causes.

Users should make appropriate backups of important images.

13. Third-Party Services

SnipCam uses Google Play and other third-party services for some functions. A suspension, outage, specification change, or change to the terms of a third-party service may affect the availability of part of SnipCam.

Each third-party service is subject to the terms established by its provider.

14. Operation and Image Quality

We use reasonable efforts to develop and maintain SnipCam, but we do not guarantee:

• Operation on every device
• Operation on every Android version
• Identical processing speed at all times
• Perfect background removal
• Perfect preservation of subject edges
• Generation of an image suitable for a particular purpose
• Continuous operation without interruption or error

15. Changes to the App

We may change SnipCam functions or specifications for reasonable reasons including quality improvement, feature additions, security measures, changes to Android or Google Play, or changes to the technologies used by the app.

Functions provided free of charge may also change in the future. Paid services will be handled in accordance with applicable law and Google Play rules.

16. Suspension or Discontinuation

We may temporarily suspend all or part of SnipCam where necessary for maintenance, outages, security issues, suspension of third-party services, legal requirements, or other unavoidable circumstances.

We may also discontinue SnipCam for reasonable reasons. If an active SnipCam Pro subscription exists at that time, we will take any necessary action in accordance with Google Play mechanisms and applicable law.

17. Our Liability

If a user suffers damage due to a cause attributable to us, we will be responsible in accordance with Japanese law.

Where legally permitted, if damage results from our ordinary negligence, our liability is limited to ordinary and direct damages.

This limitation does not apply in cases of our intentional misconduct or gross negligence, or where liability cannot be limited under the Consumer Contract Act or other mandatory law.

18. User Violations

If a dispute or loss involving a third party arises because a user violates these Terms, the user is responsible for addressing the matter, except to the extent the cause is attributable to us.

19. Privacy

The handling of photos and other information relating to SnipCam users is governed by the SnipCam Privacy Policy.

20. Changes to These Terms

We may amend these Terms where reasonably necessary due to changes in law, changes to the app, or other circumstances. If a change materially affects users, we will provide notice of the change and its effective date through the app or another appropriate method.

21. Governing Law

These Terms are governed by the laws of Japan.

If a dispute arises concerning SnipCam or these Terms, the parties will first seek to resolve it in good faith. If litigation becomes necessary, jurisdiction will lie with a court of Japan having jurisdiction under applicable Japanese law.

22. Controlling Language

These Terms may be provided in English or other languages for convenience.

The Japanese version is the controlling version. If there is any inconsistency in meaning or interpretation between a translation and the Japanese version, the Japanese version prevails.
